Subject Matter of the Contract

These GTC govern the digital booking of rides with driver (NCC – Noleggio con Conducente) via the “tommy” app or website.

The ride contract is concluded exclusively between the passenger and Tirol Bus GmbH. The platform serves for the arrangement and management of the booking; the actual ride may in part also be carried out by authorized third-party companies.

Legal Framework

The applicable legal provisions apply, in particular the Codice della Strada, Law 21/1992 (NCC), as well as the regional and municipal regulations of the Autonomous Province of Bolzano.

“tommy” is not a taxi service. Spontaneous street pick-ups are excluded. Prices are displayed digitally in advance, and booking is required exclusively via the app or website.

Booking & Ride

The booking is made by opening the app or visiting the website, entering the pick-up and destination address, selecting the vehicle and confirming the ride.

Advance bookings are possible at any time. After booking, driver details such as name, vehicle and license plate may be shown to the user. Live tracking is expected to be available from June 2026. Multiple stops may be booked within the scope of the offered functions.

Prices & Payment

The price is based on distance, duration, day of the week, time of day and vehicle type. The total price is shown to the user before the booking is completed.

Credit and debit cards are available as payment methods. PayPal as well as mobile payment with Apple Pay and Google Pay are expected to be available from June 2026.

A digital invoice is automatically issued after each ride.

Cancellation & No-Show

Cancellations are possible at any time via the app.

Fees may apply if the free cancellation period has expired or in the event of a no-show.

There is no right of withdrawal under the Codice del Consumo insofar as the services concern a specific date or period.

User Obligations

Users are required to correctly state the pick-up and destination address, appear on time at the agreed location, treat the driver respectfully and comply with the legal safety regulations – in particular the obligation to wear a seat belt.

Misuse of the platform, non-payment or other misconduct may lead to suspension of the user account.

Safety

To ensure safety, drivers may be verified, in particular with regard to identity, driving licence, experience and – where предусмотрено – additional background checks.

Safety measures include GPS tracking, the display of vehicle and driver information in the app, as well as a rating system. The live location sharing feature is expected to be available from June 2026.

In case of problems during the ride, the emergency function provided in the app may be used or customer service may be contacted.

Data Protection

Personal data is processed in accordance with the GDPR and Italian data protection law.

In particular, account data, location data and payment information are processed to the extent necessary for the use of the service.

Users may request the deletion of their data within the scope of the applicable legal provisions.

Complaints & Dispute Resolution

Complaints may be submitted via the app or through customer service.

Disputes may be handled through the European Online Dispute Resolution platform or through national mediation bodies.

Final Provisions

Italian law shall apply. Place of jurisdiction is Bolzano, unless mandatory consumer protection provisions provide otherwise.

Should individual provisions of these GTC be wholly or partly invalid or become invalid, the validity of the remaining provisions shall remain unaffected.

By confirming the booking, the user accepts these General Terms and Conditions.
